1. Scope of the terms and conditions of sale
These terms and conditions govern by operation of law all the sales of holidays on campsites by Blulidays to its customers through its internet site
www.blulidays.com.
Every customer acknowledges having read and understood these terms and conditions prior to any reservation of a holiday, for him/herself and any other person included in the party. Thereby, any reservation of a holiday implies the acceptance by the customer without reservation of these terms and conditions, as well as the specific terms featured on the individual information file of each campsite.
In accordance with the provisions of article L.113-3 of the Consumer Code and the provisions of the Tourism Code, these terms and conditions are made available to the customers for consultation prior to the conclusion of any holiday sales contract. The customers can obtain them by writing to the head quarters of the website.
Blulidays can, at any time and without notification, modify these terms and conditions it being understood that such modifications cannot be applied to earlier reservations.
2. Capacity of the customer
All clients acknowledge having the legal capacity to contract to the conditions described in the terms and conditions of sale set out below, meaning they are of legal majority and not under guardianship.
The capacity of the customer is essential for the conclusion of this contract.
3. Description of the holidays for sale
All the information concerning the location of the campsites in which the holidays are offered, the type of accommodation, their situation, their level of comfort and their main characteristics, their certification and tourist classification correspond to the regulations and purposes of the country in which they are situated and are defined in the description of each holiday for sale.
The classification attributed to each campsite featuring in the description corresponds to a classification established in reference to the local standards in the host country, and which may therefore differ from French standards. Blulidays undertakes to inform the customers as precisely as possible about the conditions of the accommodation. The assessments given in the descriptions result notably from Blulidays’ knowledge of the establishments and comments sent by customers.
Blulidays undertakes to regularly check the campsites featured on the website in order to respect the trust the customers have in Blulidays.
Blulidays undertakes to illustrate its offers through realistic photos or illustrations of the holidays on sale. It is however stated that the photos and illustrations featuring in the descriptions are simply illustrative and are in no way contractual.
4. Booking
Only a single payment in full will validate the reservation.
Blulidays offers its customers help in financing their holiday if they wish.
Any reservation, to be valid, must be made through Blulidays, and must be preceded by acceptance of these terms and conditions.
Blulidays will accept the reservation by sending, to the e-mail address indicated by the customer at the time of booking, confirmation of the reservation.
Reservations will be firm and irrevocable after validation by the customer.
However, Blulidays reserves the right, within a period of 72 hours from the validation of the reservation by the customer on the internet site, to annul the reservation if the holiday reserved is unavailable for whatever reason. In this case, Blulidays will inform the customer as quickly as possible by e-mail to the e-mail address provided by the customer at the time of booking. The reservation will be cancelled and the cost of the holiday will not in any circumstances be debited. Any payment in full of the holiday implies the acceptance of the terms and conditions of sale.
Only the type of accommodation indicated on the exchange voucher can be offered to the customer on his/her arrival.
5. Exchange Voucher
The confirmation e-mail (sent within 72 hours of the reservation) will act as an invoice and exchange voucher. The customers must then print it and keep it in order to be able to prove the existence of the reservation.
On arrival at the campsite, the customer will be asked for this exchange voucher by the manager so that the services can be provided in the best conditions.
6. Statutory cancellation period
The statutory measures relating to the right to a cancellation/”cooling-off” period in the case of distance selling as provided for in the Consumer code are not applicable to tourist services (article L.121-20-4 of the Consumer code).
Therefore, for any booking of a holiday with Blulidays, the customer has no right to any cancellation period.
7. Cancellation of the reservation on the customer’s request
Any request to cancel a reservation by the customer must be made by registered mail with proof of receipt to the following address :
Blulidays
Boulevard de la plage
66440 TORREILLES
Without cancellation insurance, no reimbursement, following a cancellation, will be possible.
In any event, the costs of processing the reservation will not be reimbursed.
Moreover if the customer would like an additional safety measure, he/she has the possibility of taking out as an option at the time of booking, cancellation/curtailment insurance with Blulidays for a defined cost on the amount of the holiday before tax, excluding tourist tax.
Several formulas are available to the customer.
However, the insurance premium and the cost of processing the reservation will not be reimbursed, if the customer does not respect the payment deadline, Blulidays will consider that as a cancellation on the part of the customer, irrespective of the conditions of form set out above.
8. Cancellation or modification of the reservation by Blulidays
Three scenarios may be implicated :
- If, before the start of the customer’s holiday, Blulidays, due to an event outside its control, is forced to modify one of the main elements of the contract, the customer may have recourse to claim for any potential damages suffered, and after having been informed by Blulidays by e-mail. The customer will therefore have the right:
- either to terminate his/her contract and obtain without penalty the immediate reimbursement of any amount paid.
- or to accept the modification or a substitute holiday offered by Blulidays; an additional clause to the contract detailing the modifications made will be then signed by the parties; any decrease in price being deducted from the amounts potentially remaining due by the customer and, if the payment which has already been made by the customer exceeds the price of the modified service, the overpayment will be refunded before the date of departure.
- If, before the departure of the customer and due to no fault of the customer, Blulidays cancels the holiday, he must inform the customer by e-mail. Without prejudice to any claim for damages suffered, the customer will obtain from Blulidays immediate reimbursement and without penalty of any amounts paid. Instead of the measures set out above an amicable contract may be concluded by which the customer accepts a substitute holiday offered by Blulidays.
- If, after the departure of the customer, Blulidays finds it is unable to provide the services anticipated by the contract without justification, Blulidays must immediately apply the following measures, without prejudice to recourse for any damages potentially suffered :
- Either offer services as a replacement for the anticipated services, bearing the additional cost. If the services accepted by the customer are of an inferior quality, Blulidays must reimburse the price difference.
- If Blulidays cannot offer replacement services or if they are refused by the customer, Blulidays must provide the customer with tickets enabling the customer to return in a respectable fashion to the departure point specified by the customer.
9. Conditions of the sites
The client is obliged to scrupulously respect the respective arrival and departure times at each campsite. The customer must therefore refer to the specific conditions of each campsite. If these times are exceeded an extra day will be invoiced. Most of the campsites have electric hook-ups compliant with the new European standards, of which the available capacity is stated in the specific conditions of the campsite. In the event where a plot does not have an electricity supply, adapters will be offered for sale on the customer’s arrival.
Reservations will only be considered after presentation of the exchange voucher featuring the deposits and the confirmation costs paid. Only the people listed on the voucher will be able to stay at the campsite.
The amount of the deposit is fixed freely by the managers of each campsite.
10. Rental conditions
The amount of the deposit as well as the amount of deposit returned are at the discretion of the managers of each campsite. For safety reasons, the number of occupants specified for each type of rental accommodation must not be exceeded.
In the event where a campsite accepts animals, it must have an identification tattoo and a vaccination certificate and must be kept on a lead on the site. A daily charge will be requested by the campsite on arrival.
In any event, it is essential to refer to the specific sales terms of the chosen campsite.
11. Campsite rules
The customer is obliged to respect the rules and regulations of each campsite in which he/she is staying.
The customer must therefore pay the deposit requested. On arrival, the customer will be able to read the regulations of the chosen campsite.
The customer is responsible for checking if the services offered correspond to his/her request. The campsite manager is the only person responsible for checking that the campsite’s rules are respected as well as settling any complaints with the customer.
The customer who has booked his/her holiday through Blulidays is obliged to respect without fail the internal regulations of the campsite in the same way as a customer having booked any another way.
12. Price
The prices of the holidays offered by Blulidays at the time of booking are in euros, inclusive of VAT.
The prices indicated include only the accommodation (conditions described on the Blulidays website). They do not include notably fee-paying activities offered by the campsite, extra services, transport, meals and consumed items. All these services must be paid directly by the customer to the campsite where he/she is staying.
However, Blulidays offers its customers assistance with regard to transport, cancellation insurance and financing details of which can found in the services section of the website.
It is important to underline that certain additional taxes imposed by the authorities are to be paid at the campsite exclusively by the client as they are not part of the price payable to Blulidays.
The customer must pay €39.50 for the cost of processing the reservation as well as the tourist tax, the amount of which will be indicated in the description of the holiday.
There shall be no entitlement to any reimbursement for any holiday curtailed, shortened or any service not consumed by the customer.
13. Payment methods
In order that payment is as secure as possible and complies with the regulations in force, Blulidays accepts online payments only by bank card (VISA, Eurocard, MasterCard).
Blulidays requests that its clientele respects the following condition. The customer must pay the full price, as well as the cost of processing the reservation and any applicable tourist tax, as soon as the reservation is made. Only this condition will be considered as valid.
Financing facilities are offered to our customers. The specific conditions relating to this financing are explained in detail in the relevant section.
14. Late arrivals, early departures
The customer shall be entitled to no reimbursement in the event of a late arrival or early departure. However, if the customer has taken out the cancellation insurance offered by Blulidays, refer to the conditions of article 7.
Au-delà d'un délai de 24 heures à compter de l'heure d'arrivée prévue par le bon d'échange et de l'absence de nouvelles par le client, le camping aura la possibilité de relouer le séjour.
15. Responsibility of Blulidays
Blulidays undertakes towards the customer to respect the obligations arising from the holiday sales contract. However, Blulidays may be exonerated from part or all of its responsibility for operations concluded with its customers; by providing proof that the failure to execute or the poor execution of the contract is the fault either of the customer or of an unforeseeable or insurmountable failure by a third party to supply the services provided for by the contract, or to a force majeure.
16. Insurance and autorisation
Blulidays is insured for professional liability by the company AGF the head quarters of which are located at 2 place de la Concorde 66250 Saint Laurent de la Salanque in the terms of contract no. 41971972.

17. Claims

The claim must be accompanied with all justifying documents, specifying the reference number of the dossier, to the address of the headquarters of Blulidays.
Beyond this deadline, no claim will be considered.
The customer must also address a copy of the said claim to the service provider concerned.
No claim will be considered regarding loss, theft of luggage, clothes or personal objects being under the surveillance of the customer during the stay.
18. Applicable law
